1. General
- These Terms govern the use of the BCR Bilans application (the "Application"), made available in Microsoft Teams by BCR Group Sp. z o.o., ul. Kowalska 5/203, 20-115 Lublin, Poland, KRS 0001187674, NIP 9462756777 ("BCR Group").
- The Application is a tool supporting the performance of the accounting services agreement between BCR Group and the client (the "Client"). Use of the Application is not a separate service and is not charged separately unless the agreement with the Client provides otherwise.
- The Application may be used only by persons authorised by the Client to whom BCR Group has issued an access account, and by BCR Group staff.
- In case of conflict between these Terms and the accounting services agreement, the agreement prevails.
2. Functions
- Retrieval of the Client's purchase and sales invoices from the Polish national e-invoicing system (KSeF) under an authorisation granted by the Client.
- Reading of documents provided by the Client as scans or photos.
- Retrieval of balances and transaction history from the Client's bank accounts with the Client's consent (section 4).
- Matching of bank transfers to invoices, presentation of receivables and payables, a list of counterparties with the result of verification in public registers.
- Preparation of payment files for the Client to upload in its own online banking. The Application does not initiate, authorise or execute any payments.
- Communication between the Client and the BCR Group accountant regarding documents (questions, clarifications, notifications).
3. Account and access
- The user account is an account in BCR Group's Microsoft 365 environment assigned to the Client. Sign-in requires multi-factor authentication.
- The user undertakes not to share sign-in credentials and to report any suspected unauthorised access to BCR Group without delay.
- The Client is responsible for the actions of persons to whom it has provided access and must inform BCR Group when access should be revoked (e.g. when a person leaves).
- A user sees only the data of the Client to which they are assigned.
4. Bank account access
- Account information access is provided through Enable Banking Oy, a licensed account information service provider (AISP) under PSD2, with which BCR Group has an agreement.
- Consent is given by a person authorised on the Client's account in the bank's own interface, using strong customer authentication. The consent covers only reading balances and transactions; it does not cover payment initiation.
- Access remains active until withdrawn or until the expiry set by the bank. Regulations require strong customer authentication to be renewed at least every 180 days; the bank may require it more often. The Application notifies the Client before the renewal date; without renewal, data retrieval stops.
- The Client may withdraw access at any time in the Application, at its bank, or in writing to BCR Group.
- Data is retrieved automatically up to four times a day and on the user's request.
5. Payment files
- The Application prepares a payment file based on the payables visible in the Application and checks the payees' accounts against the Polish VAT taxpayer list.
- Before authorising the transfers in its bank, the Client verifies the payee, account number, amount and title of each transfer. Authorisation in the bank is the Client's sole decision.
- BCR Group is not liable for transfers authorised by the Client on the basis of a file whose data was changed after generation, nor for transfers to an account indicated by the Client against a warning shown by the Application.
6. Use of artificial intelligence
- Reading of scans, transfer matching and posting proposals are prepared with the use of language models.
- Every automatically generated proposal is reviewed by a BCR Group accountant before it is entered into the books. BCR Group remains responsible for the correctness of the books under the accounting services agreement.
- Data shown to the Client in the Application (balances, receivables, payables, statuses) is for information only and does not replace financial statements or tax returns prepared by BCR Group.
7. Client obligations
- Providing complete and legible documents within the deadlines set in the agreement.
- Granting and maintaining the KSeF authorisations and bank consents needed for the Application to operate, where the Client uses these functions.
- Responding within a reasonable time to the accountant's questions sent through the Application.
- Not uploading unlawful content or documents unrelated to the Client's business.
8. Availability
- BCR Group endeavours to keep the Application continuously available, subject to maintenance windows announced in advance where possible.
- The Application depends on third-party services (Microsoft, KSeF, banks, Enable Banking). BCR Group is not liable for their unavailability.
- If the Application or Microsoft services are unavailable, the Client may send documents and information by e-mail to the address stated in the agreement and, where necessary, by post or in person at BCR Group's office. Contractual deadlines are counted from receipt of the document through any of these channels.
9. Complaints
- Complaints about the operation of the Application may be submitted to info@bcr-group.pl or in writing to BCR Group's registered office, stating the Client, a description of the problem, the date of the event and, if possible, a screenshot.
- BCR Group responds to a complaint within 14 days of receipt. If the explanation requires the involvement of a third party (bank, Microsoft, Enable Banking), BCR Group informs the Client and indicates the expected date.
- Complaints concerning accounting services are handled as set out in the agreement.
10. Liability
- BCR Group's liability for accounting services is governed by the agreement with the Client and applicable law. Nothing in these Terms excludes BCR Group's liability for damage caused intentionally or for BCR Group's own errors in keeping the books.
- BCR Group is not liable for the consequences of a user sharing credentials with third parties, for decisions taken by the Client on the basis of informational data in the Application without consulting the accountant, or for transfers authorised by the Client in its bank (section 5).
- The Client is responsible for the content and authenticity of the documents it provides.
11. Personal data
The processing of personal data, including BCR Group's roles as processor and controller, is described in the BCR Bilans Privacy Policy available at bcr-group.pl/en/bilans/privacy-policy and in the data processing agreement concluded with the Client.
12. Termination
- Access to the Application ends upon termination of the accounting services agreement. Within 30 days of termination, BCR Group hands over the Client's documents and statements in PDF, XML and CSV formats or in an agreed format.
- For 14 days after termination the Client keeps read-only access to the Application to download its data, unless security requires immediate blocking; in that case data is handed over through another channel.
- BCR Group may block a user's access in case of a breach of these Terms or a security threat, informing the Client and stating the reason.
13. Changes to the Terms
- BCR Group may amend these Terms for important reasons: changes in law, changes in the Application's functions, changes of service providers, security reasons or the need to remove ambiguities.
- BCR Group announces an amendment in the Application and on this page at least 14 days before it takes effect, indicating the scope of the change.
- A Client who does not accept the amendment may stop using the Application before it takes effect by informing BCR Group; this does not affect the accounting services agreement, and documents are then exchanged through the channels in section 8(3).
14. Final provisions
- These Terms are governed by Polish law.
- These Terms are available in Polish and English. In case of discrepancies, the Polish version prevails.
